Welcome to Hatgeb.

These Terms and Conditions govern the use of the Hatgeb application, website, and related services. They explain the rights and obligations of users, the platform, and participating sellers and service providers.

Please read these Terms carefully before using the platform, creating an account, or placing an order. By using Hatgeb, you acknowledge that you have read and understood these Terms and agree to comply with the provisions applicable to your use, without prejudice to any rights or protections granted to you under applicable law.

1. Definitions

For the purposes of these Terms, the following words and expressions shall have the meanings set out below:

Hatgeb or the Platform: The Hatgeb application, its website, and related services.
Operating Entity: Treem for Technology, under its legally registered name.
User: Any person who accesses, browses, or creates an account on the Platform.
Customer: A User who purchases a product or requests a service through the Platform.
Seller or Service Provider: A store, business, establishment, or other entity offering products or services through Hatgeb.
Order: A purchase transaction or service request submitted through the Platform.
Delivery Representative: A person or entity responsible for delivering an Order in accordance with the applicable service arrangements.
Offers and Coupons: Discounts and promotional benefits offered by Hatgeb or participating parties, subject to the terms announced for each offer.

2. Nature and Scope of the Platform

Hatgeb is a platform that combines electronic intermediation with direct sales.

Depending on the nature of a transaction, Hatgeb may operate in either of the following capacities:

Electronic Intermediation: The Platform enables Users to browse products or services offered by independent Sellers or Service Providers and facilitates order submission, communication, and transaction processing through the available services.
Direct Sales: The Platform may offer products sold directly by Hatgeb. In such cases, the purchasing relationship is with the entity identified as the Seller in the Order details or relevant transaction documents.

The identity of the Seller and the party responsible for fulfilling an Order shall be determined by the information displayed to the User for the relevant transaction.

The use of Hatgeb does not mean that the Platform is the direct Seller of every listed product. Similarly, acting as an intermediary does not exempt any party from responsibilities imposed by applicable law.

3. Eligibility and Account Registration

Users must have the legal capacity required to enter into the transactions they conduct through the Platform.

When creating an account, Users agree to:

Provide accurate, complete, and up-to-date information.
Provide a valid telephone number and appropriate contact details.
Keep login credentials confidential and not share them with unauthorized persons.
Update account information when necessary.
Avoid using their accounts for fraudulent or unlawful activities.

Users are responsible for safeguarding their login credentials, subject to applicable law and circumstances in which unauthorized access results from a security failure or another cause not attributable to the User.

Hatgeb may take appropriate measures where there are reasonable grounds to suspect fraud, misuse of the Platform, or a violation of these Terms, while respecting Users' legal rights.

4. Products, Descriptions, and Prices

Products and services are displayed based on information provided by Hatgeb, the relevant Seller, or the Service Provider.

Reasonable efforts are made to maintain accurate product descriptions, images, prices, and availability information. However, unintentional errors or stock changes may occur.

The following provisions apply:

The applicable price, currency, and fees are displayed before an Order is completed.
Prices and availability may vary between Sellers, locations, and promotional periods.
Product images may be illustrative, but products must conform to their essential advertised specifications.
Sellers and Service Providers are responsible, within the limits of their legal obligations, for the accuracy of information they provide about their products or services.
If a material error affects a price, description, or availability, the situation will be addressed in accordance with applicable law. Available options will be explained to the Customer, and additional charges will not be imposed without the Customer's consent where required.

Nothing in this section affects any mandatory consumer rights under applicable law.

5. Placing and Confirming Orders

Users may submit Orders through the features available on the application or website.

Before confirming an Order, Customers should review:

Selected products and quantities.
The total price.
Delivery charges and any other disclosed fees.
Delivery address and contact details.
Payment method.
Any special conditions relating to the product or offer.

Acceptance of an Order is subject to product availability and acceptance by the relevant Seller or Service Provider, depending on the transaction.

Order status will be communicated through the application or messages, where such features are available.

Submitting an Order does not, by itself, guarantee product availability or delivery unless confirmation has been provided in accordance with the applicable procedures. This does not affect any contractual obligation that has already arisen.

6. Product Availability and Substitutions

A product may become unavailable after an Order is submitted due to stock shortages, changes in availability, or other operational circumstances.

In such cases, the Customer may be contacted and informed of the available options, which may include cancelling the affected product or Order or selecting a suitable substitute.

A substitute product or price increase shall not be imposed without the Customer's consent where such consent is required.

If an Order cannot be fulfilled in whole or in part after payment has been made, any amount refundable to the Customer shall be processed in accordance with applicable law, the payment method, and the relevant refund policy.

7. Delivery and Receipt

Delivery arrangements vary depending on the service, Seller, and geographical area.

Delivery may be handled by Hatgeb, the Seller, or another delivery service provider, as indicated to the User when placing the Order.

Customers agree to:

Provide an accurate and clear delivery address.
Provide a reachable telephone number.
Reasonably cooperate to facilitate delivery.
Review delivery details before confirming the Order.

Delivery times are estimates unless expressly stated otherwise.

If a delivery is delayed or cannot be completed, the Customer may contact customer support to follow up on the Order.

Cases involving an incorrect address, inability to contact the Customer, or failure to receive an Order shall be handled in accordance with the disclosed policy and applicable law. Additional fees shall not be imposed unless they were disclosed in advance and are legally permissible.

8. Prices and Payment Methods

Hatgeb makes available the payment methods displayed to the Customer during checkout, which may include:

Cash on delivery.
Electronic payment through the payment methods available on the Platform.

Available payment methods may vary according to the type of Order, service, and location.

Customers must pay the amount displayed for the Order after applicable discounts and disclosed fees have been applied.

Electronic payments may be subject to the technical and operational terms of the relevant payment service provider.

Payments and refunds shall be processed through the methods available and applicable to the transaction.

Users must not use another person's payment details without authorization or use payment methods for fraudulent transactions.

Hatgeb will not ask Users to disclose their banking passwords or confidential verification codes.

9. Order Cancellation

The ability to cancel an Order depends on its status at the time the cancellation is requested and the nature of the product or service.

The applicable procedure may differ depending on whether the Order is awaiting acceptance, being prepared, out for delivery, or already fulfilled.

Hatgeb or the relevant Seller may cancel an Order for legitimate reasons, including:

Product unavailability.
Inability to fulfill the Order or complete delivery.
A material error that cannot lawfully be corrected.
Reasonable grounds to suspect fraud or unlawful activity.
Circumstances that prevent the service from being performed in accordance with applicable law.

If a paid Order is cancelled, any refund due shall be processed in accordance with the payment method, applicable law, and relevant policy.

Cancellation fees shall not be applied in a manner that violates consumer rights or conditions that were required to be disclosed before the Order was confirmed.

10. Exchanges, Returns, and Refunds

Exchanges, returns, and refunds depend on the nature of the product or service, the entity that sold the product, the reason for the request, and applicable law.

Procedures may differ between products sold directly by Hatgeb and products supplied by independent Sellers through the Platform.

Customers may submit a return request or complaint through the official contact channels, providing the Order number, the reason for the request, and any information reasonably required to process the case.

All mandatory consumer rights shall be respected, including rights relating to defective products, products that do not conform to their advertised specifications, and transactions that are not fulfilled in accordance with the agreement and applicable law.

Certain products may be subject to specific legal exceptions due to their nature, storage requirements, or use. Such exceptions shall apply only to the extent permitted by law and shall not be used to deprive Customers of mandatory rights.

Refunds due shall be issued through an appropriate payment method in accordance with the procedures and timelines applicable to the transaction.

A policy adopted by an independent Seller does not waive or override the Customer's mandatory legal rights.

11. Offers, Coupons, and Discounts

Hatgeb or participating Sellers may provide promotional offers or discount coupons subject to the terms announced for each promotion.

Offer conditions may include:

The start and end dates of the offer.
Minimum Order value.
Eligible products or stores.
Maximum discount amount.
Permitted number of uses.
Conditions for combining discounts, if any.

Offers and coupons must not be used fraudulently or in a manner that circumvents their conditions.

Promotional offers may be amended or discontinued in accordance with their stated conditions and applicable law, while respecting confirmed Orders and rights that have validly arisen.

12. Pharmacy and Health-Related Products

Where pharmacy or health-related products are made available through Hatgeb, transactions are subject to the nature of the product, the entity supplying it, and applicable regulatory requirements.

The relevant Seller or Service Provider is responsible for obtaining the licences required for its activities and complying with the legal requirements applicable to its business and products.

Medicines and restricted products may only be listed, sold, or delivered in accordance with applicable legal requirements.

General health information and product information displayed on the Platform are not a substitute for professional medical or pharmaceutical advice.

Users should follow the approved instructions and warnings applicable to each product.

Complaints involving health-related products shall be handled according to the nature of the complaint, the responsible party, and applicable regulations.

13. User Obligations and Acceptable Use

Users must use the Platform for lawful purposes and must not:

Provide false or misleading information.
Use the Platform for fraudulent or unlawful transactions.
Manipulate Orders, offers, or coupons.
Attempt unauthorized access to the Platform's systems or other users' accounts.
Disrupt, compromise, or misuse the service or its security.
Infringe intellectual property rights or the rights of others.
Publish unlawful or abusive content through any interactive feature made available on the Platform.

If these Terms are violated, appropriate measures may be taken, including restricting or suspending an account, taking into account the seriousness of the violation and applicable law.

14. Responsibilities of Sellers and Service Providers

Each Seller or Service Provider is responsible for the obligations imposed on it by law and by its agreement with the Customer, according to the nature of the transaction.

Within the scope of its responsibility, this may include:

Ensuring the accuracy of product and service information.
Honouring advertised prices and specifications.
Providing products that conform to the Order.
Complying with applicable licences and regulatory requirements.
Respecting consumer rights.
Addressing complaints relating to the products or services it supplies.

Hatgeb's responsibilities shall be determined according to its actual role in each transaction, whether acting as a direct Seller, an intermediary, or a provider of another service.

Nothing in this section exempts Hatgeb, a Seller, or a Service Provider from any liability imposed by law.

15. Ratings and Feedback

If the Platform allows Users to submit ratings or feedback, such submissions should relate to genuine experiences and must not contain unlawful material or violate the rights of others.

Hatgeb may review ratings that violate these requirements and take appropriate action.

Nothing in this section prevents Users from lawfully expressing their experiences or submitting complaints about products or services.

16. Privacy and Personal Data Protection

Hatgeb handles Users' personal data in accordance with its Privacy Policy and the laws applicable in the Arab Republic of Egypt.

Depending on the features used by the Customer, the information processed may include:

Account and contact information.
Delivery address.
Order and transaction details.
Technical information required to operate and secure the Platform.
Location data when a feature requires it and the necessary permissions have been obtained.

Data may be used for legitimate purposes related to operating the Platform, fulfilling Orders, communicating with Users, handling complaints, and securing accounts, in accordance with the Privacy Policy and the applicable legal basis.

Necessary data may be shared with the relevant Seller, delivery provider, or payment provider to the extent required to complete a transaction, subject to applicable law and the Privacy Policy.

Users should review the separate Privacy Policy for further details about data collection, use, retention, sharing, and data-subject rights.

17. Notifications and Marketing Communications

Hatgeb may send notifications relating to Orders, accounts, and account security, depending on the service.

Marketing messages and promotional offers are subject to applicable consent requirements and legal provisions.

Users may manage application notifications through their device settings and use available unsubscribe mechanisms for marketing communications where applicable.

Unsubscribing from marketing communications does not prevent the delivery of necessary messages relating to Orders or account security, to the extent permitted by law.

18. Intellectual Property

The Hatgeb trademark, logos, designs, software, and content owned by the Platform are protected by applicable intellectual property laws and belong to their respective rights holders.

No protected material may be copied, modified, republished, or commercially exploited without the rights holder's permission, except as permitted by law.

These Terms do not grant Users any ownership rights in Hatgeb's trademarks, content, or technical systems.

19. Platform Availability and Updates

Hatgeb seeks to operate the application and website in a stable and secure manner, but uninterrupted or error-free availability cannot be guaranteed at all times.

Updates, maintenance, or feature changes may be made for operational, security, or legal reasons.

Hatgeb will make reasonable efforts to address technical issues without prejudice to obligations relating to paid Orders or Users' legal rights.

20. Limitation of Liability

Hatgeb's liability shall be determined according to its actual role in the transaction, the nature of the product or service, and applicable law.

Hatgeb is not responsible for the independent acts of Sellers or Service Providers except to the extent required by law or by obligations that apply to Hatgeb itself.

Hatgeb shall not be liable for losses arising exclusively from circumstances beyond its reasonable control, to the extent permitted by applicable law.

Nothing in these Terms excludes mandatory legal liability or limits consumer rights that cannot lawfully be excluded or restricted.

21. Account Suspension or Termination

Hatgeb may restrict, suspend, or terminate access to an account for legitimate reasons, including fraud, unlawful use, repeated serious violations, or security risks.

Any action shall be appropriate to the circumstances and shall take into account Users' rights, existing obligations, outstanding amounts, and applicable legal requirements.

Account suspension does not prevent a User from exercising legal rights or submitting a complaint concerning the decision.

22. Amendments to These Terms

Hatgeb may update these Terms when necessary to reflect service changes, clarify procedures, or comply with changes in applicable law.

The updated version shall be published on the application or website with its revision date.

Where applicable law requires renewed consent to a particular amendment, the required procedures shall be followed.

Amendments shall be applied in a manner that respects accrued rights, existing Orders, and prior contractual obligations, in accordance with applicable law.

Users may contact Hatgeb to enquire about Orders, submit complaints, or request assistance.

24. Governing Law and Dispute Resolution

These Terms are governed by the laws applicable in the Arab Republic of Egypt, to the extent applicable to the relevant relationship or dispute.

Where appropriate, the parties may seek to resolve disputes amicably by contacting customer service.

If an amicable resolution cannot be reached, the dispute may be referred to the competent courts in accordance with applicable jurisdiction rules.

Nothing in this section deprives Users of any legal right, complaint mechanism, or remedy available to them under applicable law.

25. Final Provisions

If any provision of these Terms is found to be invalid or legally unenforceable, the remaining provisions shall remain effective to the extent permitted by law.

These Terms shall be read together with the Privacy Policy and any additional policies relating to specific products or services, provided such policies are clearly presented to Users.

If any provision of these Terms conflicts with a mandatory legal requirement, the applicable mandatory legal requirement shall prevail.
